A 2018 United States Supreme Court opinion in which the Court held that, in order for an area to be eligible for designation as “critical habitat” under the Endangered Species Act of 1973 (16 U.S.C. § 1531et seq.), it must be habitat for listed species pursuant to 16 U.S.C. § 1533(a).  Further, the Court held that a decision by the secretary of the United States Department of the Interior not to exclude an area from critical habitat under 16 U. S. C. §1533(b)(2) was subject to judicial review.
