Property Law. Under the rule in Shelly’s Case, a limitation of an estate to an ancestor for life, with the remainder to his heirs or the heirs of his body, gives the whole estate in fee to the ancestor. This rule applies only where the estate in freehold and the estate in remainder are created by the same instrument as in the Preamble.
