The Identity Theft and Assumption Deterrence Act (18 U.S.C. § 1028) makes it a federal felony for one to use another’s identity with the intent to commit any unlawful act under either state or federal law. Any violation of this act are investigated by federal agencies, including but not limited to, the FBI, Secret Service, and Postal Inspection Service. Violations are prosecuted by the Department of Justice.
This law allows for restitution to the victims.
