Ultrahazardous Activity


The term “ultrahazardous activity” (also sometimes referred to as an “abnormally dangerous activity”) refers to an activity which necessarily involves a risk of serious harm to the person, land or chattels of others which cannot be eliminated by the exercise of reasonable care and is not a matter of common usage or is inappropriate to the place where it is carried on.  The person or entity engaged in an ultrahazardous activity is strictly liable if such activity causes harm/damages to another.
