Mistake (Defense to Intentional Torts)


Mistake could be a defense to an intentional tort where (1) the defendant is under a duty to act for the protection of the public interest (e.g., a cop arrests a person under the mistaken belief that said person committed felony); or (2) a person acts in self-defense or in defense of others (e.g., a person hits another while under the reasonable belief that the other individual was about to strike him).
